Waypoint Trading Co. is operated by Waypoint Trading Co.. These Terms govern your use of the Waypoint platform and related services.
1. Acceptance of Terms
By creating a Waypoint account or using Waypoint services, you agree to these Terms of Service, the Privacy Policy, and the Risk Disclosure.
2. Eligibility
You must be at least CONFIGURE_ME years of age and be able to form a binding agreement. You are responsible for ensuring your use of Waypoint is permitted under your broker, prop-firm, employer, and local laws.
3. Account Security
You are responsible for maintaining the confidentiality of your credentials and for activity under your account. Notify Waypoint promptly of unauthorized access.
4. Permitted Use
You may use Waypoint for lawful, authorized personal or organizational use consistent with these Terms, including educational and software-assisted trading workflows you choose to enable.
5. Prohibited Use
You agree not to misuse Waypoint, attempt unauthorized access, interfere with platform integrity, abuse messaging systems, reverse engineer proprietary systems beyond rights permitted by law, or use the platform for unlawful purposes.
6. Intellectual Property
Waypoint software, branding, content, and proprietary technology remain the property of Waypoint and its licensors. Membership grants a limited, non-exclusive, non-transferable right to use the authenticated application as offered.
7. Pete / AI Features
Pete is an AI-enabled component of Waypoint. AI output can be incorrect, misinterpret information, miss market changes, produce inconsistent results, and depend on data availability and configuration. Do not assume AI-generated statements are guarantees. Pete is not described as a licensed financial adviser, broker, fiduciary, or portfolio manager.
8. Third-Party Services
Waypoint may integrate third-party providers (communications, payments, cloud hosting, market-data, brokers, and similar). Those services are subject to their own terms where applicable.
9. Broker / API Connections
If you connect a broker or API, you authorize Waypoint to use the connection according to the permissions and settings you configure. You remain responsible for your broker account, orders, and compliance with broker/prop-firm rules.
10. SMS Communications
SMS is optional and governed by the SMS Messaging Terms and your separate consent. Reply STOP to opt out. Reply HELP for help.
11. Trading Risk
Trading involves substantial risk of loss. See the Risk Disclosure. You are solely responsible for trading decisions and account outcomes.
12. No Investment Advisory Relationship
Waypoint provides software and educational technology. Unless separately and accurately disclosed by the company under applicable law, Waypoint does not provide personalized investment, legal, tax, or financial advice and does not create an advisory, brokerage, or fiduciary relationship by your use of the platform.
13. User Responsibility
You are responsible for deciding whether to enable trading functionality, selecting account/broker connections, setting risk limits, monitoring accounts, understanding broker/prop-firm rules, reviewing orders and positions where appropriate, and all gains or losses in your accounts.
14. Availability / Service Interruptions
Waypoint may modify, suspend, or discontinue features. We strive for reliability but do not warrant uninterrupted availability. Market data, connectivity, broker systems, and third-party services may fail or delay.
15. Limitation of Liability
To the fullest extent permitted by applicable law, Waypoint and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, trading losses, or data loss arising from use of the platform. Nothing in these Terms excludes liability that cannot be limited under applicable law.
16. Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless Waypoint from claims arising out of your misuse of the service, your trading activity, or your violation of these Terms or applicable law.
17. Termination
Waypoint may suspend or terminate access for violations of these Terms, security risk, or non-payment where applicable. You may stop using the service and request account closure subject to applicable policies and legal retention requirements.
18. Changes to Service / Terms
We may update these Terms. Material changes may require re-acceptance. Continued use after notice of changes constitutes acceptance where permitted by law.
19. Governing Law
These Terms are governed by the laws of CONFIGURE_ME, without regard to conflict-of-law principles, except where mandatory consumer protections apply.
